RHINO NATURE TERMS AND CONDITIONS
PLEASE READ CAREFULLY
These Terms and Conditions (“T&C”) define the terms of use of the website https://rhinonature.com (“Website”) and the purchase of the Rhino Nature application (the “App”). Both the Website and the App are services (“Services”) provided by Przemysław Doliwa, ul. Brzask 21/1, 60-369 Poznań, Poland (“we”). By using the Services, you accept the T&C.
Accepting the T&C on behalf of a legal entity means a declaration of having the appropriate authorization to make declarations of will and to conclude contracts on behalf of that legal entity.
The T&C cannot be accepted by entities without legal capacity.
Installation or use of the App means that the user has read the EULA and the T&C and accepts their content in full and undertakes to strictly comply with them.
Violation of any of the provisions of the T&C will result in blocking access to the Services and in pursuing claims.
Summary (TL;DR):
In order to use the App, you must purchase the selected License and activate the License Key. As a result, an agreement is concluded with us under the terms and conditions set out in the T&C and the EULA.
We offer a 15-day trial period (“Trial”).
Sales, returns, and customer service are handled by our official Merchant of Record, Paddle.com.
The App is a plug-in for Rhinoceros. To use the App, you must have the current version of Rhinoceros and meet the appropriate hardware requirements.

Purchase and activation of the App
In order to use the App on a device, you must:
Have Rhinoceros installed on this device,
Select and purchase an available License,
Download the App installer from the Website and activate the License Key.
Purchase of a License requires the following data:
Country of location,
Email address,
Payment data (name, surname or name of the payment card owner, payment card number, payment card expiry date and CVV code),
Discount code (if applicable).
Providing payment data is also necessary when a discount code entitling to a 100% discount has been entered. If such a discount code is valid, the payment card will not be charged.
After purchasing the License:
The user will receive a transaction confirmation via email from Paddle.com
The user assigns the device to the acquired License in the user account on the Website.
The License Key may be displayed in the user's account on the Website. Team members (in the case of multiuser Licenses) should contact the person who has access to the user account for this purpose.
To activate the License, start the App and click the activation button. Managing the License and active devices is possible through the user's account on the Website.
To change the devices on which the License has been activated, please visit your user account on the Website. Then, the same License Key can be reassigned to the same or a different device.
Payment details, such as payment card number, payment card expiry date and CVV code are not stored by us. Other data such as name, address, country of location and email address are stored by us for the purposes of necessary identification of the user to issue a License or for contact to resolve an error reported by the user.
Trial period
We offer a 15-day trial period ("Trial") during which you can use the App for free.
After 15 days from the activation of the License Key, the Trial License expires, the License Key's status becomes expired, and the App stops working.
Payment methods and invoices
By purchasing a License, you consent to the payment of all applicable fees related to the use of the Services, as set out on the Website.
By providing your payment details, you consent to the payment for the selected License, and you authorize us to charge your credit / debit card via our payment service providers.
To the extent that payment processing is provided by third parties, we are not responsible for the acts or omissions of these parties.
Our sales are handled by an online distributor Paddle.com ("Paddle"). Paddle is the Official Distributor - Merchant of Record for all our orders. Paddle also handles all customer service inquiries and returns. For more information, please read: Paddle Buyer Terms and Conditions.
In the event that payment is unsuccessful or not made on time, we may cancel or suspend your access to the Services immediately. If you contact your bank or payment card issuer to decline or withdraw payment for the Services, we may terminate your access to any Services at all.
After entering your email address and location, we will ask you to choose a payment method. In this step, you can also enter your tax identification number and company data. To do this, go to the appropriate form, click the "Add VAT number" button. Please note that our payment provider may not support VAT payments in some countries. In this case, the button will not be available. A full list of countries where our current payment provider is registered to handle VAT invoices can be found here.
System requirements and technical support
The App has been tested and runs on the following operating systems:
Windows 7 64-bit;
Windows 10 64-bit.
The App may also run on other versions of Windows, but we neither guarantee nor provide technical support in this regard.

Third-party websites
The Services may link to websites that we do not operate, control, or maintain ("Third-Party Websites"). We do not endorse any Third-Party Websites and make no representations or warranties with respect to Third-Party Websites. Any links to Third-Party Websites are provided for your convenience only. When you access Third-Party Sites, you do so at your own risk, and you waive any and all claims against us regarding the Third-Party Sites or our links to them.
Consumer rights
The conditions set out in this chapter apply only to Consumers (natural persons using the Services in a manner not directly related to their business or professional activity). Any provisions of the T&C that are inconsistent with the consumer's rights resulting from generally applicable legal provisions do not apply, and in their place, the general provisions apply.
Complaints regarding the Services may be sent by email to the following address: support@rhinonature.com. Each complaint will be dealt with as soon as possible, but not later than within 30 days.
By activating the License Key within 14 days from the date of purchase, the consumer agrees to start using the App before the deadline to withdraw from the distance sales contract. After activating the License Key, the consumer can no longer exercise the right of return and retains the right to use the acquired License.
The consumer has the right to take advantage of out-of-court means of dispute resolution. For this purpose, you can apply to the competent Provincial Inspectorate of Trade Inspection to:
initiate a mediation procedure for the amicable settlement of the dispute;
resolve the dispute arising from the concluded sales contract before the Permanent Court of Arbitration operating at the Provincial Inspectorate of Trade Inspection.

Information on specific risks related to the use of the Services
The basic threat to every Internet user, including people using online services, is the possibility of "infecting" the ICT system by various types of software created mainly to cause damage, such as viruses, "worms" or "Trojan horses". To avoid the risks associated with this, including those appearing when opening email messages, it is important that the user has an antivirus program on their device and constantly updates it, installing its latest versions as soon as they are available on the market. We would also like to inform you that special risks related to the use of the service provided by electronic means, including the one described in the T&C, are related to the activity of the so-called hackers aimed at breaking into both our system (e.g., attacks on our websites) and the user. Therefore, you acknowledge that despite the use of various, modern "defense" technologies, there is no perfect protection against the above-described undesirable actions.
Final provisions
The T&C are applied and interpreted in accordance with Polish law, and any disputes arising therefrom will be resolved by a competent court in Poland.
The T&C come into force on 30 July 2021
We may change the content of the T&C and the manner of using the Services by notifying about it on the Website and additionally via emails sent to the email addresses provided by users. By continuing to use the Services, you accept the changes made. Within 7 days of notifying users of the changes to the T&C, the user has the right to submit a declaration of non-acceptance of these changes. The declaration must be submitted in writing to the address of our registered office, or to the email address: support@rhinonature.com
